A complaint has been made against Supreme Court of Canada Chief Justice Wagner to the Canadian Judicial Council (CJC) by a group of 13 Lawyers. Their complaint highlights comments that were made by Wagner during the Freedom Convoy in Ottawa earlier this year.

The comments, directed at protestors of “seeking to bypass the political system” and “the beginning of anarchy where some people have decided to take other citizens hostage, to take the law into their own hands, not to respect the mechanism. … That, I find that worrying.” are not only inappropriate for a person in Justice Wagner’s position, but they also drive a larger wedge in our society and undermine our Judicial System as a whole.

Many will recall the Freedom Convoy’s press releases with the organizers and their legal counsel and that they were repeatedly calling for opportunities to have a conversation with representatives from the Federal Government. These calls were consistently ignored and the responses from public officials were often themed with vitriol toward protestors and rhetorical talking points of an illegal blockade.

Police on Guard has previously covered Justice McLean’s decision on the injunction against the convoy’s use of air horns and honking. In his decision Justice McLean stated the following: “THIS COURT ORDERS that, provided the terms of this Order are complied with, the Defendants and other persons remain at liberty to engage in a peaceful, lawful and safe protest.”

Judges and Justices who publicly state opinions on political, legal and social matters not only undermine Canadian’s faith in our legal system, but it is also against the ethical principles for persons acting in those capacities as outlined by the CJC.

Police on Guard believes in the rule of law and a fair, impartial Canadian Justice System. We will continue to follow this issue and sincerely hope that the CJC will diligently investigate this complaint.
