A formal appeal has been filed by those hoping to overturn the recent bombshell ruling by Justice Mosley. This is the case where Mosley determined that the application of the Emergencies Act against the convoy in Ottawa, and all subsequent actions taken under its protection, were unlawful and unfounded.
Loberg Ector LLP commenced proceedings in Ontario Superior Court of Justice(Ottawa) on behalf of 20 victims of the Trudeau government’s unconstitutional misuse of the provisions of the Emergencies Act in February, 2022.
It is with great enthusiasm that we share the most recent federal court decision dated January 23rd, 2024, on the Liberal government’s use of the Emergencies Act as a means of ending the 2022 Freedom Convoy in Ottawa.
Federal Court Justice Richard Mosley succinctly states, “I have concluded that the decision to issue the Proclamation (of the Emergencies Act) does not bear the hallmarks of reasonableness – justification, transparency and intelligibility – and was not justified”.
The Justice Centre for Constitutional Freedoms reports that, Christine DeCaire was arrested on February 18th, 2022, after the Emergencies Act was invoked. She was charged with mischief, obstructing/resisting an officer, and disobeying a Lawful Order. She has been acquitted by the Ontario Court of Justice on March 23, 2023, of all charges laid against her.
