Emergencies Act Ruled Unconstitutional

It is with great enthusiasm that we share today’s federal court decision on the Liberal government’s use of the Emergencies Act as a means of ending the 2022 Freedom Convoy in Ottawa.

Federal Court Justice Richard Mosley succinctly states, “I have concluded that the decision to issue the Proclamation (of the Emergencies Act) does not bear the hallmarks of reasonableness – justification, transparency and intelligibility – and was not justified”.

This decision comes as a result of a challenge put forward by the Canadian Civil Liberties Association (CCLA) and joined by several other groups.

A statement from the CCLA earlier confirmed “the federal government’s decision to declare a public order emergency under the Emergencies Act in early 2022, as well as the associated regulations that it enacted, were unreasonable and were not justified on the facts or the law. The regulations violated the Charter right to freedom of expression and the right to be secure against unreasonable search or seizure.”

Justice Mosley found that the actions of the convoy did not rise to the level of a true threat to national security, as defined by law, and as is required for the invocation of the Emergencies Act. The invocation was not legitimate and renders all subsequent actions as equally invalid.

Further discussion is sure to arise in the coming days and weeks once all details and ramifications of this decision are absorbed.

True to form, the Liberals responded publicly to this ruling by expressing their intent to appeal. They have yet to accept responsibility for any of the actions they have taken, since gaining power, those that contravened Canadian law or harmed our citizens. Why should we expect anything different this time.

Perhaps it is finally time that the Liberal government is to be held to account for their blatant disregard for the rights and freedoms of Canadians.

We applaud the CCLA and collaborators, their legal teams, and supporters, for their excellent work and determination.

There is much more to be done to restore the glory of our country but today has restored the hope of many.
