Ottawa has refused to disclose documents pertaining to their application of the Emergencies Act (EA), in direct opposition to recommendations of the Public Order Emergency Commission (POEC), citing the protection of cabinet confidentiality over the concerns of the public.

In the aftermath of the Emergencies Act being used against the Freedom Convoy, and resulting public outcry over what was seen as a gross overreach by government, the POEC was tasked to evaluate. Not surprisingly their finding determined that the cabinet was justified, having met the “very high” threshold needed to invoke the act. What more can be expected of a group handpicked specifically to find as such? This is in direct conflict with a federal court ruling that found the use of the EA against protestors to be ‘both unreasonable and unjustified, and an infringement on the Charter Rights of citizens.’

The POEC assessment put forward 56 recommendations, aimed at all levels of government, toward future applications of the EA. One such recommendation stated that in any future declaration of a public order emergency, the government should provide the resulting commission of inquiry with “all of the inputs to Cabinet and to ministers on the issue”.

Ottawa was given one year to respond to the POEC recommendations. That date has passed without acknowledgement.

What we need is a clear determination of exactly when (or if) confidentiality can be used to withhold information from the public, by those entrusted with speaking for the public. If the government is to be accountable, that accountability is to the people, not to one another.

This amazing country belongs to us, the people of Canada, and their power to lead exists only because we grant it to them through election. We have allowed a minority government, limited in their power by the will of the people, gain unelected (opposition) support and the power of a majority government; together these parties have destroyed Canada and the lives of Canadians in ways never seen before.
