Supreme Court of Canada Denies Hearing Constitutional Challenge Regarding Covid Mandates for Manitoba Churches

This is the final ruling for a group of five churches who stood together against the Manitoba government, challenging their covid restrictions as having unfairly targeted their fundamental freedoms of religion and peaceful assembly.

The initial decision in the case, heard by the Manitoba Court of King’s Bench, ruled that ‘the government’s public health officials should not be “second guessed” and that the government need not meet a high threshold of providing persuasive evidence to demonstrably justify that violations of the Canadian Charter of Rights and Freedoms were reasonable.’

In short, we should not be allowed to second-guess government officials, and there is no need for the government to justify restricting our rights; an appalling statement from a legal system purported to uphold the Charter of Rights and Freedoms.

The first appeal, filed December of 2022 by the Justice Centre for Constitutional Freedoms (JCCF) with the Manitoba Court of Appeal, was dismissed in June of 2023.

JCCF then filed an Application for Leave to Appeal with the Supreme Court of Canada in September of 2023. Their decision, issued in March of this year, has again seen the request for appeal dismissed. There is no higher court in Canada to look to, to protect our rights and freedoms.

To put into context the restrictions at the height of covid in Manitoba – Churches were closed while other businesses were allowed to fully operate including taxis, in-person university classes, film and tv productions, law offices and liquor stores. Professional teams could meet and train indoors without limitation. Outdoor gatherings were reduced to no more than five people, while hundreds could legally gather indoors at big box stores. Can anyone really believe these decisions were made out of concern for the people?

What recourse remains if we cannot look to our highest courts to support the laws of our country and ensure the rights of the individual are protected?

We know there are some who secretly agree with the concerns of the people. To those Judges we ask, when are you going to honour your oath? It’s time to find your integrity and your voice!

When God wants to judge a nation, he gives them wicked rulers. Today we see hearts without the Lord God Almighty, homes without discipline, schools without prayer and courts without Justice. This story illustrates a chronic pattern of lies and incrementalism toward a totalitarian Communist agenda of control over people. Thanks to the political ruling class, in our two tier racialized “justice” system we have dysfunctional courts, co-opted by liberals in Canada and Democrats in the U.S. Intentionally politicized with years of liberal appointees “beholden” to their political masters. Citizens can no longer rely on such courts with their “false compassion” for the murderer and rapist rather than victims for example…and today, in our 1984 dystopian society, as Voltaire said, “It is dangerous to be right when the government is wrong.”
THE SOLUTION: One of the hidden blessings of an advanced state of war is that we see the attacks of the enemies and know what they seek to destroy.
Today they attack truth, so we must defend truth. They attack holiness and sanctity, so we must strive to be saints. They want us to despair, so we must place all our hope and trust in Jesus. Throughout the Bible, we find details on how we are to employ these spiritual weapons that God gives us: “Put you on the armour of God, that you may be able to stand against the deceits of the devil. For our wrestling is not against flesh and blood, but against principalities and powers, against the rulers of the world of this darkness, against the spirits of wickedness in high places. Therefore take unto you the armour of God, that you may be able to resist in the evil day, and to stand in all things perfect. Stand therefore, having your loins girt about with truth, and having on the breastplate of justice.” (Ephesians 6:11-14)
