Why has no one been arrested yet?
 
 

We have been receiving many comments from people voicing their displeasure and concern as to why no arrests have been made to any government officials in relation to the breaches of our Charter of Rights or for their actions during the Covid-19 pandemic.

The short answer to this is simply that this is an enormous undertaking and is going to take time.

Currently there are several lawsuits before the civil courts in relation to the charter breaches that were committed by the various levels of government throughout the pandemic. Police on Guard is involved in 2 of them. One of which includes hundreds of federal and federally regulated employees challenging the vaccine mandate for employment as well as the vaccine passports.

We believe that these legal challenges are the first step in holding people directly accountable. These matters will allow the courts to make rulings on the legalities of the measures imposed based on the totality of all circumstances, including but not limited to, current legislation, case law and scientific evidence.

Citizens must understand that there are different burdens of proof required in civil vs criminal court. Civil courts rely on a balance of probabilities or something equating closer to a 51% likelihood of the allegation being proven. Criminal courts rely on the “beyond a reasonable doubt” burden of proof which is more like 99%. The most difficult part of criminal proceedings is proving intent. The act being committed is not all that is needed for conviction. The prosecution needs to prove that those who did wrong, did so deliberately, knowing their actions were illegal.

In the context of the pandemic, it must be proven that the officials being charged criminally knew their actions were going to cause people harm or, based on what they knew at the time, they should have known it would cause harm and chose to do so anyway. Simply put, proving intent adds another very difficult hurdle to get over. This is also known as Mens Rea, the “guilty mind”.

We wish for our followers to know that Police on Guard is here for the long haul. We are committed to upholding the Charter of Rights and Freedoms and the continued protection of Canadians. This is a big storm, and we are prepared and willing to face it head-on and do whatever it legally takes to achieve our objectives. Matters involving the law are more akin to a game of chess and not whack-a-mole. Patience, tact and precision are needed to navigate this system and we are committed to drawing on our experience, knowledge and skills to do so.
