To clarify. The Charter does supercede all other legislation unless the infringement on individual liberties can be proven necessary under section 1 (Please see our previous post on the Oakes test). In the case of the EMCPA and the Reopening Ontario Act, while they are Provincial laws, they are still subject to the Charter. This is clearly stated in EMPCA section 7.0.2. As Police on Guard has previously stated, the public health orders can not interfere with guaranteed individual freedoms of protest, speech, assembly, religion, mobility.
