Canadian Civil Liberties Association Victory in Case Against Trudeau

A recent ruling has given the Canadian Civil Liberties Association (CCLA) an advantage in their legal action against Trudeau’s government and the use of the Emergencies Act.

Exactly one year after its invocation, and against much contesting from the government, the judge has ruled in favour of the CCLA’s request to use select evidence obtained during the Emergency Act Enquiry in their own case against the Trudeau government.

Their Director of Fundamental Freedoms, Cara Zwibel, stated “The government had tools other than the Emergencies Act” noting “it did not meet the high legal threshold to invoke the act. There was a blockade in Ottawa that needed to be addressed, but the government did not need new tools to do so.”

The “high legal threshold” mentioned is known as the Oakes Test; the legal requirement set out to accommodate the rare (and, as of yet, never seen) circumstance where the government may need to legally suspend our charter rights due to a significant threat to our nation. The Charter requires that they ‘demonstrably justify’ the existence of the threat while proving the ineffectiveness of all other tools available.

The convoy represented the largest display of peaceful protest we have seen, with a goal of ending Covid-19 mandates in Canada. The outcome would have been different, had Trudeau agreed to meet with the organizers. Instead, he ran from every opportunity and ultimately invoked the Emergencies Act to deal with peaceful blockades. His cowardly decision caused unwarranted arrests, seizure of bank accounts to the tune of over 8 million dollars, and the destruction of many people’s livelihoods that, for some, continues more than a year later.

The EA Commission’s ruling has since been released and, unsurprisingly, has found Trudeau justified in the invocation. However, the hearings exposed a great deal of lies, manipulation and copious evidence that requires further scrutiny.

This is far from over. And, while we may struggle to find individuals in our judicial system with integrity, we are thankful that judges, like this one, apply the laws of Canada in the ways in which they are intended.
