Trudeau’s Government continues its path of eroding the Charter. Section 8 of our Charter of Rights and Freedoms is short and to the point. It states, “Everyone has the right to be secure against unreasonable search and seizure.”

However, amendments to Bill S-7 will now give CBSA the right to check your devices and demand your passwords so that they may search in its entirety anything contained on your device. Section 99.01 which is being added to the Bill is called “Documents on Personal Digital Device.” This means they can look and seize everything from photos to texts and emails. The only test for this to happen is “that the officer has a reasonable general concern.”

The test that stood the test of time was always “reasonable and probable grounds to believe” which is obviously becoming too high of a standard and cannot been met with such a frivolous search which can only be described as a fishing trip.

Police on Guard continues to advocate for the Canadian Charter of Rights and Freedoms. This bill is now in the Senate for their approval.
