The Democracy Fund Gets Stay of Charges for Military Veteran Issued a $5750 Covid Ticket

A veteran of the CAF, with support from The Democracy Fund (TDF), have secured a stay of charges for the $5750 ticket issued for failing to present a PCR test upon return to Canada in 2021.
Adam Blake-Gallipeau, a 59-year-old veteran who has suffered permanent injuries from his years of service, and who lives on his meager pension in British Columbia, travelled to the US for treatment. He then acquired a rapid test which he presented at the border upon re-entry to Canada. Because the requirement at the time was a PCR test, he was promptly issued this excessive fine by the border agent.
The Democracy Fund, a Canadian charity focused on constitutional litigation, successfully argued for a stay of charges, meaning the case will no longer be pursued. In Adam’s words, “TDF took the position that (I) had a valid exemption to the PCR requirement, and that given (my) service to country and medical and financial condition, there was no public interest in pursuing this matter. Fortunately, it seems that we were able to convince the Crown of our view.”
TDF has successfully resolved many cases, having achieved the withdrawal or dismissal of roughly 800 of the 1500 ticket cases they have been retained for. “Nearly all…have been heard in court, and the majority of cases have had multiple court appearances,” Adam told Epoch.
These tickets number in the thousands and will continue to clog our courts. Frivolous tickets for arbitrary mandates that served no purpose but to scare Canadians who, in some way, acted in opposition to the government. In truth, they serve only to cause stress and anxiety for those fighting them; a gross injustice for a man suffering PTSD and worse, from his years of military service in support of this country.
