Free Speech Win

Constitutional Lawyer Rocco Galati, has many cases, one involving Doctors who were being disciplined by the College of Physicians and Surgeons of Ontario due to their criticism of covid 19 policies: Turek v. The College of Physicians and Surgeons of Ontario

On April 30th of 2021 the College of Physicians and Surgeons of Ontario, sent out a directive indicating that no Doctor or Surgeon shall criticize any policy of any public health official surrounding Covid-19 and that they may be disciplined or have their licence removed if they did.

Although the courts indicated that they would not hear the case brought forth by Mr. Galati, as the Doctors had yet to be disciplined, (and to bring the case before the court once that happens) a positive decision emerged with respect to their guaranteed right to free speech.

The courts indicated that the policy sent out by the CPSO would not have been heard as a Charter issue, as the directive is not law and not binding on doctors and is merely an opinion of the CPSO and Doctors cannot be punished for free speech.
