Patients of an Ontario Physician File Legal Challenge

Patients of an Ontario Doctor have filed a legal challenge against the College of Physicians and Surgeons in Ontario (CPSO) in an effort to protect their private medical information. This is following a complaint made to the CPSO of the physician writing medically based mask exemptions for 2 children and the college is demanding medical records for ALL patients for their investigation into the doctor’s alleged misconduct.

The complaint was filed by a non-patient, non-physician third party against the doctor when they learned of the writing of the exemptions and is another example of the weaponization of the regulatory bodies against physicians trying to do their jobs. These demands have been made to the physician by the CPSO under threat of removal of the doctor’s license.

Those with law enforcement experience would understand the scenarios required to obtain private medical information. You require express written consent from the individual patient, or a production order signed by a judge or justice after a proper legal application, which requires legal scrutiny and due diligence on the judge or justice’s behalf. For the CPSO to assume it can circumvent the legal process of obtaining such information is purely abhorrent.

This case is extremely important as it highlights the necessity to keep governing bodies such as the CPSO in their lanes and forces them to abide by the law. Recently it has become evident that they believe they have the authority to what they deem necessary at the time without regard for well-established, necessary laws.

The Patients filed their objection in January 2023 and the case is scheduled to be heard on March 30, 2023 at 10:00 A.M. at 130 Queen Street West, Toronto’s Osgoode Hall.
