Federal Employee Lawsuit Update - December 2022

 
 

The Defendants’ (Government) have made a motion to strike, and the Plaintiffs (Federal Employees’) responding motion record has been filed.

The Court now has to decide whether to dispose of the motion in writing, or after oral arguments in open Court, over which the parties disagree in that:

(a) The Government wants it disposed in writing; while
(b) We want to orally argue the motion in open Court.

After December 9th, 2022 the Court will decide whether to do it in writing or orally in court.
If the Court decides to have an oral hearing, a date has been pre-set for January 19th, 2023.

If the Court decides to dispose of it on the basis of the written motion materials filed, including the legal arguments, it will issue its decision in due course.
