On August 5th, 2022, Justice J.C. Corkery, of the Superior Court of Justice – Ontario, made a decision regarding a twelve-year-old young lady whose father was attempting to force her to be vaccinated against COVID-19 prior to the start of this school year.
This young woman, a gifted and articulate student, had come to a decision that she did not wish to be vaccinated and wished to make her opinions on such matters respected.
Judge Corkery, in his ruling, acknowledged the limitations of judicial notice within the constantly changing ‘opinions’ regarding Covid policies, citing a lack of consensus or consistency. He states, “how can you take judicial notice of a moving target?” pointing to the complete and abrupt backtracking of support for AstraZeneca and the changing position of Pfizer themselves, among numerous other examples.
He went on to list many examples where ‘facts’ have been blindly accepted only to later be discovered as false, stating “The list of grievous government mistakes and miscalculations is both endless and notorious.” and further “When our government serially pays out billions of dollars to apologize for unthinkable historic violations of human rights and security – how can we possibly presume that today’s government “experts” are infallible? Nobody is infallible.”
In another argument, familiar to many of us, his ruling has confirmed that you cannot be ordered to be vaccinated to protect others.
His final ruling allowed this young lady’s wishes to be respected and prevented her father from forcing vaccination on his daughter.
We applaud Justice Corkery for his decision based on the current science and evidence, following logic, and acknowledging the emotional and psychological effects of attempting to force vaccinate a child.
We applaud this young woman for standing strong in her convictions, for having the strength to oppose the immense weight of a parent’s demands, the peer pressures and societal manipulations, and hope she will be held as an example to other ‘mature minors’ in stepping forward with their own concerns and conclusions.
In closing, one final but important statement from Justice Corkery; “Throughout history, the people who held government to account have always been regarded as heroes – not subversives.”
