Does it pass the Oakes test?
In section 1 of the Charter rests the limitation clause. This legally allows the government to limit a person’s charter rights, however it must be proven that this limitation is justified. This is done using the Oakes Test, which determines if the purpose of the restriction is demonstrably justifiable in a free and democratic society.
We implore all active duty officers who are enforcing current Public Health orders to do extensive research on the current “State of Emergency” and ask themselves, does the legislation I’m enforcing pass the Oakes test?

We have been receiving many questions regarding the oath that police officers take. Inside the front cover of every officer’s memo book is a reminder of our oath. While the exact text may differ between jurisdictions and services, above all we have pledged to uphold the Constitution of Canada and that includes our Charter of Rights and Freedoms.
For those officers who are silent while we are ordered to enact questionable policies, mandates, and by-laws, we hope you will #RememberYourOath and join us by adding your support.

Before our first month closes, we have the honour of publishing another piece from active-duty officers, this time from Alberta.

A kind reminder to all active duty officers that the legislation, upon which the Public Health orders are based, does not supersede any Charter Right (EMCPA 7.0.2).
Peaceful protests against government actions or institutions is a guaranteed right in Canada. We urge you to #RememberYourOath and not impede on people’s rights.
Arresting peaceful protestors not only erodes the foundation upon which this country is built but subjects law enforcement to civil liability, Police Services Act charges, and criminal charges. By protecting the Charter Rights of Canadian citizens, you also protect yourselves, we are one and the same.
