Federal Employee Lawsuit Update September 2025

We have an update regarding the Federal Employees’ Lawsuit.
To recap;

In 2023, the Federal Court dismissed a lawsuit spearheaded by Police on Guard concerning vaccination mandates in employment contexts.

The decision was appealed, and in June 2024, the Federal Court of Appeal allowed some plaintiffs to proceed with their case while dismissing others.

The plaintiffs who were dismissed appealed their dismissal to the Supreme Court of Canada.

In an anticipated, yet disappointing decision, the Supreme Court has struck down the application for leave, meaning they are not willing to hear the case for those on our lawsuit that are Federally Regulated in the government sector (ie: Department of National Defense, Department of Fisheries and Oceans, Office of the Auditor General of Canada etc)

The remainder of the plaintiffs, those that are Federally regulated in the private sector (ie: WestJet, Canada Post, Air Canada) as well as those in the RCMP, will proceed back to Federal Court to have their case heard
While this outcome is extremely disappointing for a portion of the plaintiffs, it was very much expected given the political climate over the last 5 years and we are moving forward with the lawsuit.
The amended Statement of Claim has taken some time to submit, as the legal team had to wait for questionnaires to be returned by the plaintiffs and they had to be categorized for submission.
The courts now have the amended Statement of Claim and we are awaiting the courts acknowledgement of it being successfully filed. This may take a little time given the amount of plaintiffs.
Once it’s been officially stamped, the next step is to wait for a scheduled court appearance. We eagerly anticipate this case and these plaintiffs finally getting a chance to speak in court.
The Federal Employees Lawsuit has been the largest lawsuit filed to date with the number of plaintiffs and one of the few still standing making it’s way through the system.
Court proceedings are complex and constantly evolving, so keep an eye out for official updates as the legal proceedings continue.
